These terms apply when you order a print from Firmament Light Co., LLC ("Firmament Light," "we," "us") through this online store. The product listing, your cart, and your order confirmation describe the print you are buying, including the image, size, material and finish, mounting or framing, edition, price, shipping or pickup method, and sales tax. By placing your order, you ("the buyer") agree to these terms. Please review them before you check out.

1. The Print

  • Each print is made to order by a professional photographic lab on archival materials.

  • Open edition prints may be printed in any quantity. Limited edition prints are numbered and printed in the fixed edition size stated in the product listing; once the edition sells out, we will not reprint that image in that edition.

  • Not every image is available in every size or format. Available options depend on the original image file and its suitability for producing a quality print at the requested size and finish. We reserve the right to limit available sizes and formats based on image quality.

2. Color and Appearance

All images are edited using a calibrated display and processed using our customary editing and production methods. You acknowledge that the appearance of an image may vary depending on the device, display settings, screen calibration, brightness, color profile, viewing conditions, and other characteristics of the equipment used to view the image. The appearance of a printed image may also vary due to differences in paper type, texture, finish, printing equipment, ink, color reproduction, and ambient lighting. Accordingly, printed images may differ in color, tone, contrast, brightness, sharpness, and overall appearance from images viewed electronically. Such variations, to the extent consistent with customary photographic and printing tolerances, do not constitute defects or grounds for rejection, reprinting, refund, or other relief.

3. Payment and Ordering

  • Prices are in U.S. dollars. North Carolina sales tax, and any other tax we are required to collect, is added to the order. You are responsible for any taxes, duties, or governmental charges imposed on the transaction. Sales tax applies to the full order total, including shipping, delivery, and handling charges, at the applicable North Carolina state and local rate, currently 7% in New Hanover County. The sales tax is shown as a dollar amount at checkout.

  • Production begins when payment, or the agreed deposit, is received. Payment is processed by Shopify Payments (card payment through our online store, or through a secure Firmament Light invoice or payment link for in-person, text, and email orders).

  • We reserve the right to correct obvious typographical, clerical, or pricing errors, including errors in advertised prices, quotations, invoices, or order confirmations. If an error materially affects the price of your order, we may cancel the affected order by notifying you and refunding all amounts you paid for that order. We are not obligated to fulfill an order at an erroneous price.

4. Production, Delivery, and Pickup

  • We will tell you the expected production and delivery dates when you order.

  • Any stated fulfillment or delivery date is merely an estimate, not a guaranteed deadline. If we anticipate a material delay, we will notify you and provide an updated estimate. If we cannot fulfill your order within the delivery date, we will work with you to establish a revised date or, where appropriate, provide a refund. If no fulfillment date is stated, we will make reasonable efforts to ship the print or make it available for pickup within 30 days.

5. Damage and Defects

  • You agree to inspect your print upon pick-up or delivery. You further agree to report any damage or defect to Dan@firmamentlightco.com no later than thirty (30) days after delivery, and provide photographs or other documentation of the damage or defect, including the packaging for shipping damage. Please retain the packaging until we respond. We may require additional information necessary to evaluate your claim. Documented damage or defects will be replaced or refunded at our option.

  • Lost packages reported within thirty (30) days after the expected delivery date will be replaced or refunded at our option.

  • You agree that no refund or replacement will be provided for alleged damage or defects unless supported by photographs or other documentation and reported within thirty (30) days after delivery.

6. Returns

ALL SALES ARE FINAL. Because each print is made to order in the size and finish you choose, custom prints, framed pieces, metal and canvas prints, and limited editions are final sale as expressly provided in the damage, defect, and lost-package policy above. No returns or exchanges are accepted for reasons other than damage, defects, or no delivery as expressly provided herein.

7. Copyright

  • Purchasing a print transfers ownership of the physical print only. All copyrights and other intellectual property rights in the photograph remain with Firmament Light Co., LLC. No right to reproduce, copy, distribute, or commercially use the photograph is granted by the purchase.

  • You may display, resell, or give away the print as a physical object.

  • You may not copy, scan, or photograph the print for reproduction, distribute it digitally, use it in advertising, or use it to train artificial intelligence systems. Photos of the print shown incidentally in your home on personal social media are welcome.

8. Limitation of Liability

To the fullest extent permitted by law, our total liability arising out of or relating to any order will not exceed the amount you paid for that order. We will not be liable for any indirect, incidental, special, or consequential damages, including damage to walls or other property arising from the installation or display of a piece.

Please use hardware rated for the weight of the piece.

10. Disclaimer of Implied Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NO OTHER WARRANTIES ARE MADE EXCEPT AS EXPRESSLY STATED IN THESE TERMS.
